1. Acceptance of Terms

By downloading, installing, or using the Tag Pals mobile application (“App” or “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

Tag Pals is a lost-and-found app that allows users to:

  • Register NFC tags with their contact information and item details
  • Store and manage information about items they want to recover if lost
  • Share public URLs so finders can contact them when an item is found
  • Manage their profile and tag inventory

3. Account Registration

  • You must create an account to use certain features of the App
  • You agree to provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activity that occurs under your account

4. Acceptable Use

You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Register NFC tags for items you do not own or have no right to claim
  • Provide false, misleading, or fraudulent contact information
  • Use the App to harass, abuse, or harm others
  • Attempt to gain unauthorized access to the App, other users’ accounts, or our systems
  • Interfere with or disrupt the App or servers/networks connected to the App
  • Use automated means (bots, scripts) to access the App without permission

5. User Content

  • You retain ownership of the content you submit (item names, photos, contact details)
  • By submitting content, you grant us a license to store, display, and process it as needed to provide the Service
  • You represent that you have the right to share any content you submit
  • We may remove content that violates these Terms or applicable law

6. NFC Tags and Public URLs

  • When you register an NFC tag, a public URL may be generated for finders to view your contact information
  • By making a tag public, you consent to your contact details being viewable by anyone who scans the tag or visits the URL
  • You are responsible for the accuracy of the information displayed on your public tag pages

7. Intellectual Property

  • Tag Pals, the Tag Pals logo, and related marks are our property
  • The App, including its design, features, and code, is protected by intellectual property laws
  • You may not copy, modify, distribute, or create derivative works without our written permission

8. Disclaimers

  • As-is service: The App is provided “as is” and “as available” without warranties of any kind, express or implied
  • No guarantee: We do not guarantee that lost items will be returned or that finders will contact you
  • NFC limitations: NFC tag compatibility depends on your device and tag type; we are not responsible for hardware limitations

9. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid to use the App (or $10 if you paid nothing)
  • We are not liable for any loss or damage arising from your use of the App, including lost items or failed recoveries

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

11. Termination

  • You may delete your account at any time through the App or by contacting us
  • We may suspend or terminate your account if you violate these Terms
  • Upon termination, your right to use the App ceases immediately
  • Provisions that by their nature should survive (e.g. liability limitations, indemnification) will survive termination

12. Changes to Terms

We may update these Terms from time to time. We will post the new Terms on this page and update the “Last updated” date. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by the laws of Ireland (or your jurisdiction), without regard to conflict of law principles.
